1. General
The following terms and conditions apply to all orders placed by the customer (hereinafter also referred to as ”you”) on this website www.elenatezak.store, provided by Studio Elena Tezak.
We as the vendor will provide deliveries, services and offers exclusively on the basis of these General Terms of Business.
2. Customer Policy
All products bought on this website are sold directly by Studio Elena Tezak. The e-business activity on this website is solely towards end users, who are themselves final consumers. This policy is a service dedicated to individuals who are personal buyers not to be mixed with business oriented retail activity.
3. Contract Policy
3.1. Before you proceed in buying items by sending the order form, you are asked to read the herein terms and conditions.
3.2 All our offers in catalogues and on our website are non-binding. A contract becomes only effective upon the written confirmation of the order by the vendor. The order may be conducted by telephone, by email or regular mail.
3.3. Studio Elena Tezak retains title of ownership to the delivered goods until the purchase price has been paid in full.
3.4. Some pieces in this shop are made to order and it can take up to 4 weeks until they are ready to ship to the customer. Shipping times are indicated in the product description. The customer therefore agrees to this when purchasing an item.
3.5. Studio Elena Tezak warns the customer that purchased items can be subjected to a customs fee. We cannot be responsible for additional delivery fees. Please check terms and time delivery of the products and conditions for your right to withdraw from purchase as well as terms and time period for returning purchased items.
3.6 With the appearance of new prices on this online shop all other offers and prices are invalid. All prices are in EUR. All prices are inclusive of statutory value added tax plus shipping costs.
3.7. Once your order is sent via DHL or UPS – Studio Elena Tezak will send a confirmation of the sent order including terms and conditions, order description, price details, right to withdraw, and delivery schedule.
4. Warranty and Liability
4.1 All items are designed by Elena Tezak and made in Germany by Elena Tezak herself and other producers with whom Elena Tezak works closely together. All materials used are of selected quality and as indicated in the product’s details. Plated surfaces are at least 5 micrometers thick.
4.2. All items for sale in this online shop are made of materials that are subject to change over time. These changes apply to color, as some metals develop a patina, as well as surface finish. This is normal and not a valid reason for a claim. However, the customer is encouraged to follow the care instructions provided on this website. If you are unsure about what to expect from your selected item(s) Elena Tezak is happy to answer any questions.
4.3. Studio Elena Tezak is not liable for colour differences of products on pictures on this website. This is no defect and does not entitle to conversion. Colour deviations are mostly due to monitor colour settings.
4.4. Studio Elena Tezak offers to repair and renew the surface finish of your worn pieces. For information on the price please get in touch via Studio Elena Tezak’s e-mail address: info@elenatezak.com.
4.5. The legal period of warranty applies to the purchased goods as of receipt of the goods. The customer must check the delivered good for defects immediately. Defects detectable by proper checking must be reported to the vendor in writing without delay and within 8 days. In the event of justified complaints Studio Elena Tezak will undertake subsequent improvement or a replacement delivery in accordance with the customer’s choice to. If the later fulfillment is unsuccessful, the customer may on principle at his/her choice demand reduction of the payment or cancellation of the contract. Recognizable transport damages have to be immediately noted on the customer receipt of the deliverer/ by postal service.
5. Returns
5.1. The customer has the right to break the contract with Studio Elena Tezak, without any penalty nor specifying the reason, within 14 days after he/she received the items purchased on this online shop. It is also possible to change the item for another one, however the fee to return the purchased item, the difference of price with the new item, and its delivery are charged to the customer. Studio Elena Tezak assumes the responsibility of sending the exchanged item for free.
The damage or loss of the items during the return shipping is under the customer’s responsibility. This means the goods including the gift box need to be safely packaged and shipped insured to their commercial value.

5.3. In case the customer decides to exercise his/her right of withdrawal, Studio Elena Tezak will refuse returned items if the item has been worn, washed, altered, damaged or shows stains.
5.4. In the case of an effective revocation the mutually received benefits are to be returned and if so derived profits are to be returned. If the customer cannot return the services received in whole or in part or only in a deteriorated state, the customer must reimburse Studio Elena Tezak for the loss/damage incurred.
6. Place of Jurisdiction
Berlin/Germany shall be agreed upon as place of jurisdiction.
